According to Pelosi, it’s because the legislation allows the “President to violate the constitution just this once in order to give themselves cover.” That statement doesn’t make much sense. The legislation 31 current national emergencies have a one year renewal as opposed to 30 days. But how does that give Republicans cover? The disapproval of the wall national emergency is already taking place anyway and will pass the senate. They aren’t mutually exclusive.

Taking power away from the executive is generally a good thing. Taking power away from this particular executive is an extremely good thing.

I’m not 100% confident SCOTUS will say the declaration is unlawful. It was done pursuant to statutory authority giving this power to the president. Trump is in zone 1 of Youngstown Steel, as annoying as that is. Courts will need to create a new doctrine to stop this.
