So I'm filing my first mechanics lien in NY. This isn't my typical area of practice (doing it for a friend). It's for a private residence greater than 3 families. I think I have a handle on it but if anyone out there has any general tips or advice then I'd appreciate you sharing them with me!

Sorry to hijack but I'm in Ohio trying to get into lien claims. What's an appropriate fee to charge a client in these or should it be proportional to the lien claim amount? Do most lawyers do these on contingency?

I do a lot of mechanics liens. I've never heard of taking one on contingency, but I suppose you could. Just depends on how much your client can stomach handing over to you. I wouldn't do a flat fee.

Your normal billable rate should be fine. Filing the claim is not a time-intensive process. In my experience, the vast majority of liens settle without the need to litigate. I've only litigated a small handful, and most of those settled shortly after I filed a complaint to enforce.

Depending on the complexity and the amount involved I will make a determination of flat fee vs hourly. My flat fee generally is $500.00 plus disbursements.

For a complicated public improvement lien I will typically do it hourly.
