Hi Coco,

I have a guy whose passport was suspended for non-payment of child support. Generally, California requires full payment of all arrears before DCSS takes action to release the passport. The guy is willing to make payments in installments, and to condition the release of the passport on compliance with each installment payment. He needs the passport to travel for work and earn money. Does the DCSS have any wiggle room where they will release the passport and place him on a payment plan, or do regulations force them to keep the passport suspended until full payment?

I can only tell you how DCSS in our county "interprets" the regulations. We need a full payment of arrears. In regards to drivers license we just need them to pay the normal monthly payments plus the monthly arrears payments to reinstate the drivers license.

That being said when I worked in private practice there was a case in the bay area that I was in a similar situation with and they reinstated his passport with three timely monthly payments (different counties).

I know this is zero help but just contact the attorney for DCSS in that County and see what can be done.
