No. Go to the Los Angeles Superior Court's online reservation system immediately and reserve an ex parte hearing: https://www.lacourt.org/mrs/ui/UserAgreement.aspx

Otherwise you will need to pay a filing fee at the filing window when it opens at 8:00AM before heading to the department to which the case is assigned. They won't accept your ex parte motion unless you've got a receipt showing you've paid the filing fee or reserved a hearing online.

Did you give some kind of notice of the ex parte motion to opposing counsel before 10AM this morning? Do you have a declaration to that effect? If not, you're out of luck and won't be able to submit an ex parte before Friday at the earliest.

Check out the courtroom information now. A lot of judge's are very particular about how they want an ex parte presented to them. You can do this online.

For PI hub cases, they make you fill out a form usually available just outside the courtroom. You do this before going into the court. Fill it out, hand it along with a copy of your motion to the court clerk, and then they usually give you a number and have you wait in the jury box. Some judge's don't deal with ex parte motions until after running through their docket. Others prefer to handle the ex parte motions first. In the PI courts, the judge makes a ruling on the motion and any opposition submitted, they don't ordinarily hear oral arguments.

You don't file it before the hearing. You only go to the filing window to pay the fee for the hearing but since you've gotten a reservation ID, you don't need to do that. Just print out the reservation receipt and attach it to the back of the motion, behind the proof of service. Make sure to email, fax, or personally deliver the motion to opposing counsel or otherwise give them notice of the hearing by 10AM tomorrow morning.

You don't file it at the filing window. You file it with chambers. You go to the filing window just to pay the fee and get your first page stamped. Then you take the papers to the department directly.

Why didn't you just get a stipulation like your other post suggested?

I assume he's past the deadline for stipulating to a continuation of trial and the department in question requires an ex parte motion showing good cause for a continuance at this point.

I didn't do a stipulation because all parties request more than 30 days continuance (we ask for 90).

The issue here is that we had depos noticed by plaintiff's counsel.He did not meet and confer.I just sub in the case for one of the defendants. we can not properly prepare for them, so I asked plaintiff's counsel for a week extension waiving notice.he responded his calendar is full until July. we have trial date end of June. There are no propounded discovery requests since the begining of the case January 2016?!?!
So I decide to bring all parties together get extension do depos exchange request etc and eventually resolve the mess.

So I go to the filing window they stamped two copies of the ex parye app one is taken with the judge's clerk the other left for the court?

Before your ex parte application will be reviewed, the court clerk will insist on a receipt showing that you paid $60. You can pay online at the CRS or at the filing window. You already paid on CRS. You're good, you don't need to go to the filing window. They don't conform ex partes. Just give a copy to the court clerk.

In the PI hub courts, the parties can only stipulate to a continuance of up to a certain number of days ahead on the calendar. A stipulation is free, of course.

But a request for a continuance beyond that limit (over 90 or 120 days or something like that) cannot be accomplished by voluntary stipulation. One of the parties has to file an ex parte application showing good cause to continue trial beyond the set limit.

That's how it works in some of the PI courts, I wouldn't be surpassed if a lot of other departments worked the same way.

In a manner of speaking. LA has judges specifically assigned to PI matters to manage the cases as they move along. When the cases are ready for trial, that PI judge will kick it out to a different judge (maybe an entirely different courthouse) to run the trial. I'm not a fan of the system but given the glut of cases the dedicated judges are needed.

Success guys!!!I had my first ex party motion granted!!The Court continued the Trial date with 90 days😀However it did not happen in chambers.I had to give my oral arguments and position to the Judge in open Court. But success I'll get a drink or two or three!
