Can plaintiff and Defendant extend the trial date by stipulation. I made a substitution of attorney and want to reschedule the already set up trial date.

Plaintiff is agreeable to stipulation to do that or an ex parte application asking the Court ?

Any input, the case is in CA

In counties where I practice, you would file an ex parte, and state that the request for continuance of trial is unopposed. Provide your unavailable dates, and the opposing counsel's, and tell the court how long of a continuance you need, and the reason for the continuance. The first continuance request is liberally granted, but for anything past the first, you will need to really explain yourself.

Depends on the judge. Do you happen to know which county? Some judges are pretty liberal about it, others require good cause even if unopposed.

Also check on the county's website to see if there is an "official" continuance form to file. My judge wouldn't consider any continuance requests unless they were on the official form.

It is Los Angeles and I researched it and ex parte application will do it CRC 3.1200 et seq.
