I just won a small claims case at Arbitration. The Arbitration award was for $1,200. However, in my pleadings I also asked for Court Costs (filing fees + sheriff's fees). However, I forgot to specifically mention or detail out the costs at the arbitration hearing.
The Arbitration award was silent as to the court costs. Is the award supposed to be inclusive or exclusive of court costs? Can I ask for costs in addition to the $1,200 award at the Judgement on Arbitration Award call?

I am pretty sure that you need to itemize everything before the arbitrators, and the award should include the fees and costs (which is probably about, what, $420?). I can see that's a significant percentage of the award, but you may be stuck with the $1,200 unless you pay the $200 to reject the award, which seems kind of silly and counterproductive (unless you think you're owed significantly more than $1200). The JOA call will not allow you to do anything with the case except to either accept the award as the judgment, or reject the award and send it to a different courtroom for trial intake.

okay, so i have the answer to my own question now. Appeared before the judge, brought copies of my Award, sheriff's fee receipt and court filing fee receipt. Just needed to show the judge and he added it to my judgment. Easy as pie.

Update: at arbitration now, the arbitrators have been asked to announce that costs are recoverable and you can ask for them at the end of the case. I was able to get an extra $500 out of our case for the costs. Not sure where costs start and end though--maybe just filing and service fees?

I was going to ask a side question about low damage awards in general (how do you deal with a case where you only get a $2000 judgment--like, do the arbitrators EVER award pain and suffering?), but maybe this is the wrong thread...

oh you mean costs were not limited to filing fees + sheriff's fees? I thought that was all i could request. Could you also request costs like: translators, court reporter, copying, etc?

From what I hear, Arbitrators tend to give LOW awards because they don't want Defendants to reject the arbitration award.
